Legal Question in Credit and Debt Law in New Jersey

My wife recived a letter from a colection attorney.I called them and they said it was about a bill owed from a few years ago.They said they represent a bank.They also said it might have to do with credit cards,but could not give me any real answers. She has since recived a summins to appear in court.We have an excelent credit record.We do not know if we should get an attorney now, or go to court and find out what this is all about and then hire an attorney.

It is very difficult to give you a definite answer because there is much information that is left out of your question that would radically change my answer if I had that information. For instance, the amount that they are requesting may be very low and accordingly, it may not be cost effective to hire an attorney for Court. On the other hand, if you go to Court by yourself, and then say you want a postponement to get an attorney, some Judges are hesitant to do that, depending on how old the case is. Your best bet would be to gather all of your information together, make an appointment with an attorney and review the entire situation with him/her. Then you can make an appropriate decision as to the direction in which you want to go. He/she may advise you how to go about this yourself or the amount at stake may justify retention of the attorney for the Court hearing.
