Legal Question in Criminal Law in New Jersey

6 month pregnant woman (visibly showing) attacked at front door of house by woman claiming affair between pregnant woman and attacker's boyfriend. Victim did not know attacker and no contact with attacker prior assault. Police arrived and arrested attacker. Attacker charged with simple assault. Released after booking that evening. Mediation has occurred without resolution. Trial date set for next month. This incident was not a domestic violence issue. I'm unable to find any laws, rulings, etc. that deal with a matter of attacking a pregnant woman.

As a victim can I request the charges to be elevated to Aggravated Assault?

How do I ensure this case is not plead out?

Since this assault the attacker has opened a daycare. What is the best way to ensure the highest level of prosecution?
