Legal Question in Criminal Law in New Jersey

How do I file a motion to dismiss a complaint of harassment, (NJ 2C:33-4(c)) in NJ municipal court? The complaint was retalitory, made by my sister, because I called DYFS on her. The call to DYFS was with merit, no heat and hot water. Nevertheless she also signed a TRO against me, which at full trial I won and it was dismissed. In that trial the judge stated, "The plaintiff's complaint has not risen to meet any of the 14 statues required, and further I find her complaint to be retalitory in nautre." At the end of the hearing she stated, in the presence of myself, the Superior Court Judge, and myself, "That's fine, I'll just keep filing restraining orders." I want to ask for a dismissal based on the higher court's findings, as well as the fact that I had no contact with her for more that 30 days before the harassment complaint was signed.

Your sister is wrong to do this, but more importantly the Judge decided that she filed that action against you without any good reason to do that. Call me, and I will help you to put a stop to this, and to pursue her for her actions.

It would be wonderful if she said that she would "keep filing actions" loud enough to be caught on the court's recording.
