Legal Question in Criminal Law in New Jersey

Gathering information for my nephew who was recently arrested. He is 20 YO lives in NJ. We was with in person in his car and another X-Girlfriend who he hasn�t seen in months entered his vehicle without permission and refused to get out. He told her numerous times to vacate the vehicle. She refused and he drove to the campus police shack to have them remove her. She at this time vacated the vehicle and that was the end of the altercation.

The next day he was arrested at him home and charges with assault and a TRO was also issued.

What can be done being there was no assault verified by the other party who was present who will state that in court. Also in search for video proof we found no security coverage in the location this happened to prove my nephew is innocent and the charge of assault and the TRO are false.

What can we do,

What we have is a old fashioned case of "He said. She said." Your nephew needs to hire an attorney to dispute the domestic violence and assault charge because being innocent does not

control the result in a criminal case. It is the effort to defend that makes all the difference.

I always tell people that they should never go to court on a criminal charge without a lawyer because the penalties are too severe.
