Legal Question in Criminal Law in New Jersey

harassment

I wish to sue someone for harassment. However, I am currently out of the country and will not be home for a few months. This person continues to harass me even while I am away through email. My question is... Can my father or someone else take him to court for me while I am away? Or do I have to wait until I'm back in the country? I am 21 years old.

Re: harassment

An attorney can file a lawsuit for you while you are out of the country and he can have the papers served upon the defendant and proceed to serve a demand for information, but approximately six months to ten months after the lawsuit is filed you will probably have to return to New Jersey to be questioned, under oath, by defendant's attorney in a procedure known as a deposition. Additionally, you will have to return to New Jersey for the trial.

The above schedule of lawsuit events gets greatly speeded upon if you claim is for $15,000 or less because the entire case will probably last no more than four months.

Call me if you like.
