Legal Question in Criminal Law in New Jersey

Nj 2c:20-11b (2)

I am 18 years old, still in high school, and have no criminal record. A few days ago I was arrested and charged for shoplifting at a local Walmart store. The items totaled to be 15 dollars and some cents. I was given a summons to show up at the municipal court the first of June. I called the court to confirm the date. I was told that I no longer needed to appear on that date because it was being moved to superior court. So I called the superior court and was told no information was available yet. Apparently the prosecutor hasn't looked at my case yet and he might not get to it for three months or more. I am wondering if you could help me understand what I am up against [fines, jail time, and etc] and why has it been moved to superior court. Thank you for taking the time to answer my questions!

I can't understand why this was sent to the Superior Court for such a small dollar amount. I would have to see the final charge from the Superior Court before I could figure that out. Nevertheless, shoplifting is a form of theft and you are facing the prospect of having a criminal record, facing jail time, having to pay heavy fines, and having to do community service. I am an attorney who has handled many cases similar to yours in various courts throughout New Jersey in the past. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.

Shortly, you will receive a notice to appear in Superior Court for a preindictment procedure in which there will an opportunity to attempt to dispose of your case in a manner not injurious to you. You need to hire an attorney for the hearing.

The fact that your case was referred to Superior Court usually means that your shoplifting complaint charged you with taking an item with a value in excess of $200. It would seem that your matter may have been so referred in error.
