Legal Question in Criminal Law in New Jersey

i was pulled over the other day in roselle park NJ and charged with possession of paraphernalia, but not possession of marijuana. this is the first time i have ever been pulled over and first time i have been charged with a crime. i signed a letter of consent to search my car and told them the paraphernalia was belonged to me.

i have a court date set for jan 7th 2010. is there anything i can do to get a less strict penalty and if so what should i expect?

You have a choice. You can move to suppress the fruits of the search because it was unconsititutional because your so-called consent was coerced and the officer needed probable cause to conduct search BEFORE he was entitled to ask for your consent.

Your second choice is to apply for first offender treatment for possessing a small amount of ,marijuana. If granted the status you will be required to be supervised by a probation officer for six months or so and then the charge will be dismissed by the Court.
