Legal Question in Criminal Law in New Jersey

When is it statutory rape?

Ok, I met a Girl online she is 16. She posted as 18 but told me first thing up front. I am male and 21. I met her through myspace. her parents do not want her to have a myspace. I am not an auyhority figure to her in any way. Is it illegal for us to meet? For us to have a non-sexual relationship? To have a sexual relationship? to have a physical relationship but to not have sex? I have not done anything yet, but i want to know what the laws are and what her parents can do and what can happen.

Re: When is it statutory rape?

16 is the age of consent in New Jersey if there is no coercive or supervisory nature to the relationship. See N.J.S. 2C:14-2 for more details.

Re: When is it statutory rape?

Although 16 is the age of consent in this State. I would think twice about this possible relationship. You could be asking for trouble. She already lied about being 18. How do u know she's not lying about being 16? You're right on the borderline here. The consequences of a mistake about her age could affect the rest of your life if you're subject to Megan's Law. I would stay away from this whole situation. Sometimes girls this young are pushed by family members to press charges b/c the family disapproves of the age differences in the relationship. STAY AWAY FROM THIS AND YOU'LL BE BETTER OFF.
