Alcotest Hearings

Does anyone have any real info on how the hearings have gone and what the expected outcome may be? I understand that several months ago this seemed very open and shut, but now the defense attorneys seem to be speaking much more confidently. Thanks.

You seem to know as much as anyone else. You speak about the hearings recently conducted before the Honorable Patrick King, in the case of State v. Chun. Chun was a Middlesex County case, in which the Supreme Court granted certification in order to determine whether the alcotest machine is scientfically reliable, and if so, under what circumstances its results are to be offered into evidence. While the hearings are done, Judge King hasn't issued his report. You are correct, the defense attorneys involved have been optimistic. It just isn't over until the fat lady sings. Evan Levow, who is, or was, a frequent contributor to this board was one of the participants in the hearings. Perhaps he will make a report. I suppose you may be one of the defendants whose DWI sentencing has been stayed pending the outcome of the hearing. Good Luck.
