Divorce

My husband and I have been separated for 5 years. We have a daughter that is 13 years old that lives with me. i collect child support through the court. I want to file for a divorce. How long can it take? We have no property, etc. Thank you.

Once I am hired I will file prepare a divorce complaint within two or three days which you must review and sign. After the complaint is filed with the Court a copy of same must be served upon your spouse. You seem to have only two or three potential issues child custody and child support and perhaps alimony.

From your description of your situation I would feel that the divorce could be completed in three or four months.

I have read the reply of the other attorney. I can only add that how quickly you can get a divorce will depend in large part on whether your soon-to-be exhusband cooperates or fights you, or does nothing.

No-one can reliably predict how long your divorce will take; each person's divorce is a unique process, and therefore, factors that increase or decrease the amount of time for one person's divorce may not apply to your divorce.

Generally, the divorce process depends on the divorcing individuals. If the individuals agree about issues such as alimony, child support and equitable distribution, they can obtain an uncontested divorce in a few short months. If the individuals cannot agree on key issues, their attorneys may have to commence negotiations on their behalf; then, the length of the divorce will depend on how amenable each party is to compromise and settlement. In a worst-case scenario, the divorce process can take years.

The fact that you have already arranged for child support and that you have a limited asset pool is likely to decrease the length of your divorce. However, other issues, such as alimony and equitable distribution of your limited assets, may take a while to resolve.
