Legal Question in Family Law in New Jersey

Domestic Violence - Temporary restraining Order

My Wife called the police after having an argument and she accused me that I verbally and physically abused her, which is not true. The police checked her and never found any sign of violence. They asked her to go to the police station and four hours later they came back with a Domestic Violence - Temporary restraining Order and I have to go to the court next week. I was informed that I have to leave my house and not talking to her or to my daughter until seeing the Judge. What do I need to do to protect myself?

Here are some facts that may help:

2- We have a 5 Y/O daughter

3- We are married for more than 5 years but we are only together for one year in USA after getting the green card

4- Since she came to USA, she is home sick and always sad/upset

5- She could not adopt my life style as a professional and the fact that I need to work most of the day and I only have few hours to spend with her at night

6- She always try to create arguments at night so that I can not go to sleep

7- She always says that if I do not do what she wants, she will make my life miserable

8- She always try to isolate me from my family and she does not want them to come to our house

Re: Domestic Violence - Temporary restraining Order

You need to see an attorney immediately as the Domestic Violence action could have a serious impact on any professional license or reputation involved as well as impact on a future matrimonial case.

In addition, you have to consider the impact on your child who may be at risk if your wife is exhibiting signs of depression.

These are very serious issues and you should not try to handle them without legal assistance. If you care to contact this office, please do so at once.
