Legal Question in Family Law in New Jersey

emancipating a child

My daughter just finished beauty school. Her father has set up a court date to stop child support. She plans to go back to college in June or September for business so she can open her own beauty salon. What do I need to do to continue receiving child support. Does the 6-8 month break in school mean her child support will be cut off. Thanks for all your help.

Re: emancipating a child

Normally, a break in college or other post-highschool education results in emancipation. You have 3 options, 1, just go to court and argue that CS should continue and see what happens, 2, get her back in school ASAP (yes, I know this isn't easy) or 3, get an attorney to make some good arguments.

By the way, is he paying for his share of the college expenses? He should have been?

My initial consultations are always free. Call me at 732/247/3340 to discuss the case. I have offices in New Brunswick and Toms River.
