Legal Question in Family Law in New Jersey

family lawyer

i'm geting divorce and my husband wants to use the same lawyer we bouth had when we were together, he say that he is going to handle his divorce and all the courts hearing but he was the family lawyer before, can he still represent my soon to be ex-husband even if he was are lawyer before. please help me. this lawyer help us in the business and with problem i had in court before, when i we had problems with are dog he represent my husband and I in court, so i don't know if now my husband can use the same lawyer for are divorce.

If everything is as you say, then NO. He can not. And he will be in BIG trouble if he does.

You need a divorce lawyer. A smart, experienced one.

It looks like there would be a conflict of interest so the attorney could not represent either of you (even if you husband wanted him) especially without your consent - and that might not even be doable. So you would each have to retain your own counsel.

The lawyer that you both had should not be involved in your divorce because he has confidential information about both of with which puts him in conflict. You should have your own attorney and your husband should have his own attorney but not the attorney who represented both of you.
