i have joint coustody of my daughter w/ the grandmother whom in hospitalized w/ no expectation

for recovery. the birthmother passed away last week.they live in new jersey,i live in florida.i want to bring my daughter home w/ me when i return.can i return w/ her or will i need to file in court.the grandfather wants my daughters aunt to take her

This sounds like a truly tragic situation, both women dying.

You will want full custody of your daughter, but I will need more information to answer your question. I can not tell whether you will need a Court order or not.

Just based upon what you told me, if GM dies, you should have full custody. Unless and until someone files a motion, I don't see how anyone has a claim to the child.
