Legal Question in Family Law in New Jersey

In NJ, regarding a Petition for Expungement, Form A (CN 10171), specifically the Verification (last) page states: "3. I am seeking expungement of a conviction on a criminal case and I have never been granted an expungement of an indictable conviction by any state or federal court. (If you are not seeking expungement of an indictable offense, cross out #3.) MY QUESTION: if there is only an arrest record with dismissal (no conviction), should this item, #3, be crossed off to correctly complete the form?

You could list N/A because if you are only expunging an arrest, then you just state in that section that you have never been convicted of a crime. If you want contact me and I will try to guide you through it. The heading of your application should read "Application to Expungement the record of Arrest of ______________. ".
