Legal Question in Family Law in New Jersey

I was separated in July 2009. My spouse left our mutually purchased home at that time. I currently reside in the marital home. I have been paying the mortgage and all other expenses pertaining to the household since that time. We have since divorced in August 2010. My former spouse, knowing I would be out of town for a night, recently contacted me to ask if she could stay at our house for a night. Am I legally obligated to allow her to do so ?

It depends on what the Divorce Decree or Property Settlement Agreement says. Who got the house and the obligations on it? It is usually covered in those documents. If not, it may be up to a judge decide.

Keep in mind that this advice is given based on the little bit of information that you have provided in your question. My advice may change based on other information. Further, no one can rely on advice from an attorney who has not been retained. You cannot rely on this advice because we have not personally met and you have not retained me as an attorney. If you have not already done so, you should immediately meet with a Family Law attorney for a full consultation before you take any further steps. I would be happy to meet with you if you call me at 856-546-8010 and schedule an appointment. Mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner
