Legal Question in Family Law in New Jersey

My wife and I are separated and my 16 year old son lives with me. I will be out of town for 3 days. My wife has threatened to call the police if he stays in the house by himself and doesnt go to her house. He does not want to go to her house. Is he allowed to remain in my house for 3 days without me being there?

There is no specific age set in New Jersey for a child to be alone at home. The issue is whether the child is safe. It depends on the child. However, there is a lot to consider. Is it wise? have you made every effort to have the boy stay with friends or relatives instead of being alone? is this really necessary? is it wise?

your soon-to-be ex-wife may call the police, and that will be an unpleasant issue to deal with.

It seems to me that you need to deal with something else as well: you need to go to court, get a divorce and get a court Order stating that you have custody of your son.
