I lived in a co-op community in morris county new jersey. I sold the property in december of 05 the house inspection stated the septic system failed. The propriatory lease i signed when i purchased the house states the septic is the resposibility of the co-op in which they refused to look at or repair.They held twenty thousand dollars in escrow at my closing until septic issue resolved.After a few months i filed a suit against co-op and now in june they what to take over responsibility of septic and release my escrow money but my lawyer states i have to pay the lawyer fees is this true and what can i do.

I would need to look at all of the paperwork to tell you whether you have to pay anyone's attorneys' fees. And it is not clear why the Coop did not simply step up and take care of the septic; you might have a claim against them.

You might have another problem that your attorney is not telling you: if you hired your attorney just to sell the coop unit, then that attorney may not want to or may not be able to handle a fight with the coop association. You may want to talk this over with your attorney. You may want to have another attorney, who DOES handle lawsuits and also handles coops and real estate, look over the documents and give you some advice.
