Legal Question in Civil Litigation in New Jersey

My situation is me and another female got into a scuffle on a public street. After the scuffle, she ran into the back of another vehicle. She made a false statement to the police that I rammed my vehicle into the back of hers, forcing her to hit the vehicle in front of her. I took photos of the back of my vehicle as well as the front of her vehicle to show the courts proof that I did not run into her and my vehicle has no damages whatsoever. She is trying to sue me for $5,000 for the damages to her totaled vehicle. My question is does she have the legal right to do that?

First, anyone can sue anyone for anything. The questions are whether the facts will support the claim and whether you have a defense to those claims. You must notify your insurance carrier and they will provide counsel. This is generally the terms of the auto insurance contract. If the facts are as you indicate, the case will most likely get dismissed.

The legal right to sue is based upon the access court system and she has that.
