Re: Is a verbal agreement bidding

A verbal agreement can be binding under certain circumstances. Usually, a verbal agreement is binding where a party promises to give something for another party doing something and the second party does that something in reliance upon the verbal promise. This is based on the equitable principle of estoppel which stops the person from making the promise from using the defense that the agreement was not in writing. The verbal promise and the act done in reliance upon the promise must both be proven to the Court by a preponderance of the

evidence.

in order to anser your question, I need to know the subject of the agreement. The Statute of Frauds controls some agreements, as does the UCC.
