Legal Question in Employment Law in New Jersey

The company I work for has been fined by the Dept of Labor for not paying OT to employees. Now they want to write us a check for the OT owed, but then reduce our regular pay until it is payed back to the company...is this legal?

No. The company clearly doesn't get the idea. If your pay is reduced in retaliation for your enforcement of a legal right, the company may be violating other laws. If that happens, you should consult a lawyer who handles employment matters to see if you have a further claim. My firm handles matters of this type, however the efficiencies in this matter may be influcenced by your lawyer's location. (You did not give enough information for me to tell if our Burlington County NJ office can help.) If I can be of further help to you, call or email. See also: http://info.corbettlaw.net/lawguru.htm
