Legal Question in Employment Law in New Jersey

With regard to the possibility that "UNIONS, or some UNIONS, will be excluded from the 40% surtax on Cadillac health plans-my question is,

"Is there a minimum number of people required by law in order to qualify as a entity known as a "UNION"? Are there any federal statues specifically directed to a definition as to what is a "& Union" Federally speaking.

You can go to the U.S. Department of Labor web site (http://www.dol.gov/) where you can find information on unions and the requirements for forming a union. As for the provisions of the current bill that exclude certain health care plans from the surtax, there is likely to be some significant changes as the bill gets redrafted.
