If a delinquent (rent) tenant files bankruptcy, can he still be evicted?

To answer your question, no, you cannot begin or continue with an eviction proceeding when a tenant files bankruptcy. You can petition the Bankruptcy Court for relief from the automatic stay but whether the Judge will grant permission depends on the type of bankruptcy and the circumstances of your case.
