Legal Question in Landlord & Tenant Law in New Jersey

My family and I were tenants at will, month to month with no lease, with our old landlord. The house were we live was sold and the new owners are looking to reside. What are our legal options if we are willing to move out within reasonable time but think the new owners are going to file thru court to have us evicted? If we are taken to court and the owners win, how much time will we be given to move out? My girlfriend and I have 3 kids including a 9 month old. The new owners are looking to reside like I stated before, there is no communication between us and are obviously not accepting rent money.

Under NJ law you can be evicted if the LL wants the property for personal use. The have to give you two terms notice. As a month to month tenant thus means two months notice. Must be served by the start of the term.

If you do not move he has to go to court to evict you. This will take another month. If a judgment of possession is obtain you have 8 days. You can apply for a stay of up to six months. This will be granted if you meet the standard.

You can negotiate with the LL, if you wish.
