Legal Question in Landlord & Tenant Law in New Jersey

homeowner rights

Is it legal to lock someone out of a home if they are not a tenant? Can you use a notice to quit to get him out? My uncle moved himself into my aunts home and will not leave. My aunt has passed away and the home was willed to my mom and her sister, the uncle will not leave.

Re: homeowner rights

The answer is that you will need to commence an ejectment proceeding in order to have your uncle removed from the house. You should secure the services of a qualified attorney to assist you. You cannot use self-help in order to gain physical possession of the premises.
