Legal Question in Landlord & Tenant Law in New Jersey

My lease expired in May 2012 and I did not renew my lease. July 9, 2012 we discovered bedbugs and immediatly vacateed and gave the landlord one month notice. The landlord is refusing to return our security deposit because he did not receive notice on July 1, 2012. Is this legal? If I give notice July 9th and move August 9th isn't this one month notice? What recorse do I have to get my security deposit back

Assuming that your orignial lease term ended on May 31, 2012, your notice on July 9, 2012 ends your obligation to pay rent on August 31, 2012. Your landlord must account for your security deposit within thirty days from the termination of the lease. Whether the termination occurs in your case on July 9, 2012 or on August 31, 2012 is for the court to decide. For you, earlier is better so, hand over the keys if you have not already done so. If landlord does not return the money that is due when due, you are entitled to double that amount.
