Legal Question in Landlord & Tenant Law in New Jersey

I have lived in an apt with with my family for 6 yrs. The owner moved out back in may and in Oct we found out the house was on foreclosure. She denied it and we just found out after Thanksgiving that the house was sold on auction. She still denies it, we do not have a lease or anything. What rights, as paying tenants, do we have? I live there with my husband, son and I am currently expecting. She also does not want to give us out security deposit.

If the house has been sold you owe no obligation to the old LL. you can check with the Sheriff in your county to confirm a sale occurred and who the buyer was. You also should check the county clerk.

Who ever the new owner is, they step into the shoes of old LL. Under NJ law they are responsible for the security deposit. You are also protected under NJ law. Start paying rent to rent new owner.

You may wish to consider suing the old LL.
