Legal Question in Personal Injury in New Jersey

Can my lawyers resign just before end of my case? My attorneys have been caught dealing with the defense without my knowledge/My wrongful death case was supposedly settled but i never heard any terms etc..until finding out on my own some conditions had been added and they tried to slip my case through without me knowing what they were really trying to pull off.Now that i have caught them they are resigning saying i won't agree to their terms.I just thought i would have an opportuntiy to make important decisions or at least know about them.Thank anyone who can help me.

It is really unusual for them to do so. In fact, if the case is in suit a judge would have to grant a motion to be relieved of counsel if they want to withdraw their representation. Is there a motion pending? A lawyer can resign for a number of reasons, including conflicts of interest or conflicts in the way to pursue the case. However, the Court does not typically want to allow an attorney just to be relieved for simple lack of agreement.

The representative of the estate has the power to decide whether to settle or not. A lawyer cannot typically force you to settle.

I think you need a real consultation. This forum is limited since more facts are necessary to evaluate your rights and the stategy you amy wish to take.

I would be happy to discuss the case if you wish. You may reach me by phone at 800-34 NJ LAW or by e-mail.

Hope we can help.
