bank's failure to notify of foreclosure

I recently discovered that the house I owned with my ex-husband was foreclosed on without my knowledge. What are my options?

Re: bank's failure to notify of foreclosure

ho boy. you own a house jointly with your exhusband. you moved, I think, because it says you live in Virginia. He let it go into foreclosure. If you had any ownership in the house when it was foreclosed, or if you were supposed to get some part of the sales proceeds, then his stupidity has cost you money. And you could sue him for that loss.

You pretty clearly need a lawyer to advise you and pursue this for you. You may find an attorney near you who could file and pursue a claim against your ex. That is not likely. I think you will end up hiring an attorney here in New Jersey.

Re: bank's failure to notify of foreclosure

You may have an opportunity to redeem the foreclosure or avail yourself of a right of redemption by paying off whatever is owed on the property if you take action within the statutorily mandated period, whatever that may be in the jurisdiction of New Jersey.

There are more facts needed to give a complete answer. You appear to have been on title to the property with your ex husband. Were you also obligated on the loan? Did you execute any of the loan documents? Depending on the facts, there may be an opportunity to redeem, and challenges to the forecosure process-did the lender know that you had moved? You may also have a claim against your ex. You should consider hiring an attorney.
