Legal Question in Real Estate Law in New Jersey

My brother was given a home legally by my mother when our father passed away in 2002 and now is has put up a fence so she cannot enter the yard. However, there are items that belong to my mother in the yard area and his cellar. What can she do to get her items returned to her. He will not speak to the family..

Assuming the items, collectively, are worth less than $3,000, you should sue him in small claims court for the value of the items. I believe he will chose to avoid paying money for these items.

Wow, that is horrible. He turned on his own mother.

She can sue him for the items. She may be able to file criminal charges (maybe, not sure).

If she feels that the items are worth the cost, she could have an attorney demand in writing that he return the items or face a lawsuit. I would be able to do that for her.
