Legal Question in Real Estate Law in New Jersey

foreclosure

I have been served papers by the mortgage companies attorney that a foreclosure has been filed and I have 35 days to answer.

What do they mean by answer?

I have contacted the mortgage co. and they are willing to go through a modification review, however it will take a few weeks. Should I protect myself and answer to the court and tell them that I'm working with mortg. co. to modify?

Please advise.

That answer that is require is a formal response to the complaint filed with the court. It must comply with the rules of court. No amount of working with the other party constitutes an answer.

You should engage a lawyer who will prepare the answer for you and who may take other action to protect your rights. Unless you can afford to lose the property and still owe a lot of money to the lender, you should not do this yourself.
