Can I trust a mortgage company to help modify my mortgage due to hardship with out foreclosing on me...

Don't trust a company that has contacted you and is asking you for money to help you do this. If it's the company that already holds your mortgage and to whom you are supposed to be making the payments, maybe it will work out, but you would be better off if you had a lawyer in your corner. If you have a low enough income, you may be eligible for low-or-no fee legal services, if they are available in your area for mortgage foreclosure alternatives. Look into that. And good luck.
