Legal Question in Tax Law in New Jersey

My daughter lived with her mother in 2012 in pennsylvania and the mother collected unemployment all year and is now incarcerated but not convicted as of jan 2013. i live in new jersey who gets to claim the child as a dependent on 2012 taxes?

In brief, the parent who contributed the most child support, whether by payment of child support or incident of expense. For example, housing and food costs are also considered. If the child is eligible to be claimed by the non-custodial parent (you) it is better to have the mother sign IRS Form 8332 so both parents do not inadvertently claim the child for the same tax year.
