Wipers and Headlights

I was stopped on the highway by an officer. I have auto on/off headlights with always on daytime running lights. My headlights are always on, but my taillights turn on and off, depending on if the car senses it is dark enough. He was pacing me and stopped me and issued me a ticket for lack of headlights, when they were clearly on because I can't turn them off and he also issued me a ticket for speeding. I am going to plead not guilty to both, what options do I have?

Your options are to plead not guilty and go through a trial or to make some sort of deal with the prosecutor whereby the lights charge is dismissed and the speeding charge is changed to a no pointer.

Basically, a plea of not guilty should be entered. At that point the matter will receive a trial date and negotiations with the prosecutor can go forward and a deal could be cut with the prosecutor or if a deal is rejected a trial would happen. If you plead not guilty to both tickets you will get a court date to fight the charges against you. The courts prefer that if you plead not guilty to one ticket, you plead not guilty to all tickets. The speeding ticket would give points on your license, even if you have a Texas license. If you have the owners manual of the car showing that your lights are designed to always be on, that ticket can be beaten. The police need to provide your lawyer with the evidence to prove that you really were speeding. Even if they can provide that evidence, cases like that can usually be amended to some violation with a lesser number, or even zero, points.
