Legal Question in Wills and Trusts in New Jersey

In the state of New Jersey...Does the administrator of an estate have the right to take any commission from a wrongful death law suit settlement? If so how much and is it taken from the gross settlement including lawyers fees etc, wrongful death, or survival portion of the settlement?

You may need to seek court approval, but I would think that if the claim existed at the time of death, then it would be an asset of the estate. The commission would be based upon the gross amount of the award.
