Legal Question in Workers Comp in New Jersey

I have had back issue for a long time, but it never kept me out of work it usually last about a week then be fine--name removed--the other day my back was bothering me a little, then next day it was fine--name removed--i was at work rolling up an extension cord and felt a twinge. something i have felt before--name removed--the next day i was in work at my desk made a phone call then felt a sharp pain arcross my lower back. then i went to the floor, the pain was very severe. my boss called the ambulance and i went to hospital--name removed--2 days after i had a doctors appt. in which i needed an MRI. well i have a rubshurd disc. and need to have it operated on. is this claimed under workers comp. because it happened at work.?

The answer is "maybe". Have you ever been treated in the past for the intermittent back pains you say you have had? If yes, depending upon what your doctors said then, you would have to determine if you had a pre-existing condition that just led up to the ruptured disc. If no, depending upon how it is written up by your current doctor, you may be able to claim a work related injury. My advice at this time is to file for workers compensation with your company because you were at work when it happened and your boss immediately became aware of the problem. If they accept your claim then you are entitled to receive free medical care and temporary disability payments for the time you are out of work because of your ruptured disc. If they deny your claim, you have the right to proceed anyway. Either way, after you file for workers compensation, I would suggest you consult with a lawyer to discuss further rights and benefits you are entitled to receive.
