Legal Question in Bankruptcy in New Mexico

Forgot a creditor on Chapter 7 Filing

In 1997, I filed Chapter 7. Until now, I realized that I forgot to list a creditor. I don't know how it got missed since it was one of the largest liabilities. How do I have my case amended to have that missed liability included? There is no reason why I would have not listed or intended to have that liability discharged.

Re: Forgot a creditor on Chapter 7 Filing

You have to amend your Petition. You can do this before discharge by paying a small filing fee. If you are talking about after discharge you will have to file a motion to amend your schedules to include this creditor.
