Re: immigration

Yes (if there is any criminal history then you may have a problem). Feel free to contact my office if you would like to learn how the process takes place for her to get her green card.

Re: immigration

It will depend on how your friend's wife entered the USA. If she originally entered legally (tourist visa, student visa, etc.), she could be eligible to adjust status while remaining in the USA. If she was not inspected at the time she entered (entered through the border), then the matter is more complex. In any case, we would need more information regarding the situation. You and your friend can feel free to contact me to further discuss the matter in private, if you wish. We offer free initial consultations to Law Guru users. Good luck!

Re: immigration

I think your friend should have gotten to an immigration lawyer a long time ago, but it's never too late. The problem is this: if she entered the United States LEGALLY, that is with some kind of visa, your friend and she can file for her green card here in the U.S. If she entered the U.S. without inspection, then she must return to her country and consular process. That will cause some other issues to arise. But to be sure, both she and her husband should contact a good immigration lawyer to get the scoop on what can be done. (7 years together has nothing to do with her getting her papers) Good luck!
