Legal Question in Bankruptcy in New York

Bankruptcy effect on a new spouse

I am considering bankruptcy. I have recently gotten married. My debts are all in my own name and were amassed prior to marriage. Will filing bankruptcy have any effect on my new spouse?

Re: Bankruptcy effect on a new spouse

Generally no - your debts will not effect your spouse. You can file bankruptcy as an individual as long as debts are in your name. If you and your spouse have joint debts or assets of course that is a different story. But according to what you said there should be no trouble filing bankruptcy. Please call my office at (212) 745-1373 if you need help preparing the petition.
