Legal Question in Bankruptcy in New York

Chapter 7

I am looking to file a chapter 7 bankruptcy.I have about 106,000 in debt with about 25 creditors.I see that many document services will type up my case for around 200 dollars.Besides representation in court ,what else would I receive from a lawyer for the average fee which is around 800 dollars . Pro of not using an attorney

1. hire a typing service and they will fill them out as you do, no editing of any kind

2, save money on a very important thing in your life without benefit of any analaysis on what kind of bankruptcy would best suit your needs.

3. Ability to plead lack of knowledge of law so wehn you go to court and make a mistake , it will not be considered fraud.

4. Clearly the saving of money you can use for other things like entertainment.

Cons:

1-3 above

2. The lack of knowedge of the law and what you can keep in Bankruptcy could cause your case to be dismissed and you might ahve to then file under the New Law.

Face facts you dont do surgery on yourself and this is also as important.

The benefits include

1. There are laws which protect your property from being a part of the 'bankruptcy estate'. These are called 'exclusions' and 'exempt property'. Property not excluded or exempt is turned ovber to the creditors.

2. I personally accompany my clients to the 401 examination by the Bankruptcy Court which is scheduled within 60 days of your filing.

This is important. If you fail this examination, your petition will be dismissed or you will be subject to an investigation.

3. 800 may sound like a lot of money, but I have been able to save my clients much more. My clients come out ahead.

4. There are benefits to doing it correctly. One benefit is that debts may not be dismissed. If so, then you will still owe the money.

You have to be out of your mind to try to save several hundred dollars, by jeopardizing the discharge of over $100,000 dollars.

I have had clients who have saved a few hundred dollars this way, and then have lost thousands of dollars trying to repair the damage done.
