Legal Question in Business Law in New York

CORPORATE FORMATION/BUSINESS LAW Q: I'm attempting to set up a business for the sole purpose of funding an existing not-for-profit organization. After operational costs (i.e. supplies, employee salary, other business related expenses etc.) all excess would be directed towards the programs and initiatives of the not-for-profit.

Which corporate structure is ideal for this type of venture? Which organizational structure offers the most favorable tax treatment? Can the not-for-profit be the sole owner of the business or is it necessary to incorporate under the names of human beings (i.e. directors of the not-for-profit)?

These are far more complicated questions that can be adequately addressed here over a free and public Q&A forum. There are no out of the box answers here as you have a multitude of options.

If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient. Our firm is now referred by the American Bar Association (see under the New York section):
