Legal Question in Business Law in New York

I worked freelance at a company for three months. When I started, I was told there would be delays on payments, but was not given a specific time frame. Now, almost a year later, they still owe me around $8000. Throughout the year I have had some email correspondence with the owner of the company, and they would sporadically send small sums of money, but the last check was received months ago. In my most recent correspondence, I was told essentially that the difficulties and cost of running a small business are making it impossible to set a payment schedule for me at this time. I took this to mean that my asking for payment will actually hurt their company, even though I did the work for them and was promised payment. I'm starting to feel like I'll never get the money that I earned and I'm not really sure what to do about it. I feel like my only option is to take legal action but that's not something I've ever done before so I'm hesitant. What should my next step be?

You may take them to small claims court and represent yourself but the limit is below what you are owed. You may also retain an attorney to enforce your rights for a sum certain or on contingency.
