Legal Question in Civil Rights Law in New York

Mandatory Random Employee Drug Testing Statutes

Is it legal for a supervisor to handle both the sample taking of [urine samples]and results taking for that testing without sending the samples to a qualified lab to obtain the results of that testing? The testing was held at our place of employment and there wasn't any qualified personnel on site to oversee the testing and/or obtaining the results. I was demoted due to what he read in the results of my drug test. Is any of this legal?

Thank you,

Re: Mandatory Random Employee Drug Testing Statutes

Are you the member of a union? Do you have a collective bargaining agreement which directs standards for urine tests? Were you wrongly accused of using drugs? Was the drug test administered falsely? Were you forced to submit after expressing your refusal to cooperate? What do you believe was improper about the administration or the outcome of your exam?
