Automobile Dealer Promotions

As part of a promotion my local car dealer included $500 in gas vouchers to be redeemed thru a third party. The third party is now in Chapter 11. Is the dealer responsible to make good on the cards? Does the dealer have fiduciary responsibly to its customers?

Is the dealer responsible to make good on the cards?

A. No. The dealer is an agent of a disclosed principal. The principal is the entity responsible for the cards.

Does the dealer have fiduciary responsibly to its customers?

A. No.
