Legal Question in Consumer Law in New York

New Car dealership misrepresentation

I would like to know if I have any legal issue or not.

I recently wnet online looking for a new truck. I contacted the dealership by e-mail- explained what I wanted, the truck stock number and Vin number, exactly how I wanted to finance detail by detail, and called and re-emailed for confirmations several times. The dealership faxed me a finance application-I filled it out in its entirety-faxed it back to dealership all in the same day. The next day the dealership contacts me and tells me I'm all approved-come get my truck! The dealership is four hours each way from my home!

The following day I go to get the truck and the biggest scam I ever encountered is attempted to be played upon me! The finacing was not approved, the dealer wanted more money then tells me he didn't state that, then tries to sell me a lower value truck etc-etc-etc!

I have every transaction in writing to prove each and every allegation!

Do I have any recourse against the dealership or GM for this unethical scam?? They had the finance application, each and every detail regarding the sale from me in regards to financing, etc! There were no surprises in the deal after numerous phone calls and e-mails! The dealer definitely pulled a scam on me without any doubt

Re: New Car dealership misrepresentation

Whether you have any recourse depends on whether a contract was signed. Also, if the dealer is outside of New York State, the law of that state may apply. With financed vehicles, a "Retail Installment Contract" is signed that provides the terms of financing. This is usually done at the dealer.
