Legal Question in Consumer Law in New York

Fraudulent extra surprise charges after used auto sale

Hello,

I recently bought a car from a

dealership in Long Island City,

and after a lot of lying, and other

bad practices, I still went ahead

with the purchase since the price

was good.

But after signing the paperwork and

all that, I was surprised when the

first loan statement came and I saw

that it was about $4000 than it

should have been.

When I called them for explanation,

they were always ''busy'' and would

return my calls but that never

happened. Finally I went there and

asked for explanation, and turns

out the extra $4000 was smuggled

in the price in form of:

''Loan processing fee'' and ''VIN

etch insurance''.

I was never told about these extra

charges during the sales process,

so this is fraud.

There's more to the story, but we

can discuss that later.

I would like to know if I have a

good case here, and if it's worth

fighting.

Anyhow, please reply and let me

know what you think.

Thanks

You may have a cause of action for violation of the New York statute pertaining to deceptive business practices as well as the federal Truth in Lending Act. However, to determine if you have any remedy, it would be necessary to know the specific facts of the case and to review the documents that were prepared.
