Legal Question in Consumer Law in New York
My mother's gym membership exp'd in 2008, and her credit card was charged monthly without consent til 2011 despite phone calls to cancel. Is there anything that can be done to recover the money? The gym is Bally Total Fitness in New York.

First get it in writing to the CC company and Bally's (works better if you send things to the CEO's home address-that is how I do things, including my own Bally dispute years before I was an atty-Property addresses are public record, BTW). You can take them to the OAG and sue in SCC but start with the CC company. Also, know they will check to see if she was there and swiped the card as well as question why this took so long (I know sh*& happens but I know how companies work-been doing this a long time).
