Legal Question in Consumer Law in New York

Will Not Issue Copy Of Title.

My girlfriend purchased a used car from New Jersey. She lives in New York. The car was purchased in Dec 2006. To this day the dealer will not give her a copy of the title and she cannot register the vehicle without it. She has been making payments on a car she has no use for. Even the finance company won't help her. They tell her to call the dealership. She wants to return the car to them because she feels the acted very unfairly. Please help.

Re: Will Not Issue Copy Of Title.

They are in violation of the law. I assume this is in NY. She should Immediately notify the NYS Attorney General's office closest to you or in NYC or Albany. She should ask for the consumer affairs intake bureau.

She should also think about hiring an attorney to sue the dealer and if she got the finance company through them, the finance Company too. If there is Fraud and Conspiracy to commit fraud. Treble damages may ensue.

Finally if your local news has a consumer fraud bureau then they might want to help. In NYC. there is the Help me Howard fellow. I don't know where you live but you should contact the local media (newspapers too) to see if they have someone like that on their staff.

If you want to discuss this further you may reach me through the links below.

Good Luck.
