Legal Question in Credit and Debt Law in New York

Collection Agency took money for account I never owned!

My father (same name as I) opened a credit card using my info. Never paid the bill. Card was referred to collection agency. CA called me stating I owe them $$$, I told them as I am a military officer, i control my monetary business and I never had said credit card. Parents admitted to having used credit card. CA took $700 from my personal checking account, without either my knowledge or permission. Now, they won't answer their phone, my letters, my faxes. What can I do?

Thanks

The money was only taken after a judgment was entered...probably by default. The mail went to you and your parents probably ignored it.

Immediately go to the Court where the judgment was taken from and ask fr an Order to Show Cause. State in iut that you wwere in active military duty at the time because there was submitted an affidavit from the process server stating that you were not.

This should return things to a level playing field. The sooner the better. Call me for a quick free phone consult.

Good Luck
