Legal Question in Credit and Debt Law in New York

documentation to validate

stopped paying on a credit card (could not make payments) Received a letter from law offices of Daniels and Norelli on 9/5/06 stating that they have been retained by CACH, LLC to arrange for payment. (original creditor was Chase Credit Card) I sent a letter to them on 9/28/05 requesting validation. Rec'd response on 1/19/2007 with 3 copies of statemnts dated 10/31/04, 11/29/04 and 12/7/04. They want to talk to me about paymt. arrangements. Should I call them or send a letter. the amt owed on 12/07 was $5657. they are asking for $7803. Not sure how to handle this - I am very nervous about calling them and possibly saying the wrong thing. The best I can do is a very small pymt every month (living on a pension) What should I do?

Re: documentation to validate

Don't call because calls invite return calls and return calls often amount to harassment. Stick with letters and just propose what you can pay. If you don't have money in the bank and your only income is a pension, tell them that because they can't garnish your pension and it won't be worthwhile to seize a small bank account.

Don't be intimidated and don't pay any attorney fees or penalties -- just what you owe and the interest. Good luck!
